Audio Report Agreement

By accessing or using the Audio Reports feature on Bodygraph.com, subscribers (you) agree to be bound by the following terms and conditions. These terms apply to all use of audio content within the Bodygraph.com platform, including uploaded tracks and audio report generation.
1. Acceptance of Terms
1.1 Agreement to Terms. By using the Audio Reports feature on Bodygraph.com, you agree to abide by these Terms and Conditions, along with the platform’s general Terms of Use and Privacy Policy.
1.2 Responsibility for Compliance. It is the subscriber’s responsibility to review and comply with these terms before using the Audio Reports feature. Continued use constitutes acceptance of the terms in full.
2. Audio Track Upload and Content Responsibility
2.1 User-Created Content Requirement
Subscribers are solely responsible for the audio content they upload. All tracks must be:
Created by the subscriber or fully owned by them.
Free from any copyright violations, illegal content, or content copied from other sources.
Respectful in tone, free of hate speech, explicit content, or any material deemed offensive or inappropriate.
2.2 Prohibited Use and Consequences
Uploading illegal or inappropriate audio content may result in:
Suspension or termination of the subscriber’s Bodygraph.com account.
Legal action, if the content violates applicable laws or third-party rights.
2.3 File Format and Size Compliance
All uploaded audio tracks must meet Bodygraph.com’s file format and size requirements:
Accepted formats: MP3, WAV, FLAC
File size: No file size limitation, provided the length of the track remains within the subscriber’s available audio time quota.
Tracks that do not meet these specifications may not upload properly or may be rejected.
3. Audio Report Feature Access and Usage
3.1 Included Usage in Subscription. Each Bodygraph.com subscription includes 1 hour of total audio track uploads for use in Audio Reports.
3.2 Additional Audio Tiers:
Subscribers requiring more upload time can purchase additional tiers:
Tier 1: 4 total hours of uploaded audio
Tier 2: 9 total hours of uploaded audio
Upgrades are available as separate add-ons within the subscriber account.
3.3 Monitoring and Testing Responsibility
Subscribers are solely responsible for:
- Quality of the audio tracks.
Monitoring track performance after upload.
Testing each and every audio track prior to offering audio reports to their clients.
Bodygraph.com does not guarantee the playback quality of audio tracks and is not responsible for file performance issues or audio quality defects that originates from the uploads.
4. Data Retention and Deletion
4.1 Post-Cancellation Data Retention. If a subscription is cancelled, uploaded audio tracks and generated reports will remain stored at the subscriber’s account for 90 calendar days. After this period, all audio content will be permanently deleted and cannot be recovered.
4.2 Liability for Data Loss
Bodygraph.com is not liable for:
Accidental deletion or modification of uploaded tracks or audio reports by the subscriber.
Corrupted or lost data caused by improper handling or external factors.
Subscribers are encouraged to download and securely store backup copies of all original content.
5. Enforcement and Platform Rights
5.1 Platform Moderation Rights
Bodygraph.com reserves the right to:
Review, flag, and remove any tracks deemed illegal, suspicious, or in violation of these terms.
Send a notification email to the subscriber regarding such action.
5.2 Suspension and Legal Action
In cases of severe or repeated violations, Bodygraph.com may:
Suspend or permanently terminate the offending Bodygraph.com subscription without refund.
Pursue legal remedies where applicable.
6. Intellectual Property and Licensing
6.1 Ownership of Uploaded Content. Subscribers retain ownership of their original audio content. By uploading, you grant Bodygraph.com a non-exclusive license to store, process, and deliver the audio through the platform for the purpose of generating audio reports.
6.2 No Claim on Subscriber IP. Bodygraph.com does not claim intellectual property rights over subscriber-uploaded audio content.
7. Promotional Pricing and Limitations
7.1 Discounted Tier Purchases
Bodygraph.com may offer periodic discounts on audio upload tiers. Discounts are:
Valid only during the promotional window.
Non-retroactive—Bodygraph.com is not liable for missed opportunities to purchase audio upload tiers at a discounted rate.
8. Final Provisions
8.1 Amendments. Bodygraph.com reserves the right to update or modify these Terms and Conditions at any time. Continued use of the Audio Reports feature constitutes acceptance of any updated terms.
It is the subscriber’s responsibility to review these Terms and Conditions periodically to remain informed of any updates or changes. Continued use of the Audio Reports feature after such updates constitutes acceptance of the modified terms at all times. Bodygraph.com also will send email to the subscribers in case of the changes.
8.2 Governing Law. These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts in England and Wales.
By using Bodygraph.com’s Audio Reports feature, you confirm that you have read, understood, and agreed to these Terms and Conditions in full.
