Terms of Use of GoHighLevel (GHL) Extension

- Acceptance of Terms
1.1 By accessing and using the GoHighLevel (GHL) extension through your Bodygraph.com subscription (“Client,” “you,” or “your”), you acknowledge that you have read, understood, and agree to be bound by these Terms of Use.
1.2 If you do not agree, you must immediately discontinue use of the GHL extension.
- Service Description
2.1 Bodygraph.com (“Company,” “we,” or “our”) provides access to the GHL extension as a third-party integration.
2.2 Access is available exclusively to Bodygraph.com Business Plan subscribers.
2.3 Bodygraph.com reserves the right, at its sole discretion, to modify the Business Plan pricing, the extension’s usage terms, or introduce additional fees at any time, in any manner deemed beneficial to Bodygraph.com. Any such changes will be communicated with reasonable advance notice.
2.4 Bodygraph.com communicates important updates, including changes to pricing, terms, and service availability, primarily through email newsletters and in-platform notifications. It is the responsibility of each subscriber to ensure they remain subscribed to Bodygraph.com’s official newsletter and that such communications are not blocked, filtered, or unsubscribed from.
Bodygraph.com shall not be held liable for any missed notifications, including those not received due to spam filtering, delivery errors, or the subscriber’s decision to unsubscribe. Clients are solely responsible for reviewing Bodygraph.com’s website and Terms of Use periodically to stay informed of any updates or changes.
- Third-Party Service
3.1 The GHL extension is developed, owned, and operated by GoHighLevel, an independent third-party provider.
3.2 Bodygraph.com acts solely as a facilitator providing access to this integration.
3.3 Bodygraph.com has no control over GHL’s functionality, features, or performance.
3.4 Your use of the GHL extension is governed by GoHighLevel’s own Terms of Service, Privacy Policy, and related policies, which you are responsible for reviewing and complying with.
- No Liability for Third-Party Services
4.1 To the fullest extent allowed by law, Bodygraph.com is not responsible for:
4.1.1 Technical issues, errors, or malfunctions within the GHL extension.
4.1.2 Data loss, corruption, or unauthorized access to data processed through the GHL extension.
4.1.3 Business interruption, lost profits, or lost revenue resulting from use or inability to use the GHL extension.
4.1.4 Security breaches, privacy violations, or modifications introduced by GoHighLevel.
4.1.5 The accuracy, reliability, or completeness of information provided through the GHL extension.
- Technical Support
5.1 All technical issues relating to the GHL extension must be directed to GoHighLevel’s official support channels.
5.2 Bodygraph.com may, at its sole discretion, provide limited advisory support related to the GHL extension; however, Bodygraph.com is under no obligation to do so. The Bodygraph.com support team is not required to possess or demonstrate in-depth knowledge of the GHL extension’s functionality, features, or tools, and is not obligated to provide onboarding, setup, or training assistance for the extension.
5.3 Any assistance provided by Bodygraph.com, in regards to GHL extension, is offered on an “as-is” basis without warranty.
- Privacy and Data Security
6.1 Bodygraph.com is not responsible for Go High Level’s privacy practices or data security measures.
6.2 Any data you input or process through the GHL extension is subject solely to GoHighLevel’s privacy policy.
6.3 Bodygraph.com shall not be held liable for any data breaches, loss, or unauthorized access occurring within Go High Level’s platform.
- Data Retention After Subscription Cancellation
7.1 If your Bodygraph.com Business Plan subscription is canceled or terminated:
7.1.1 Access to the GHL extension will be immediately revoked.
7.1.2 Your data stored within the Bodygraph.com GHL integration environment will be retained for 90 days from the cancellation date.
7.1.3 After 90 days, all related data will be permanently deleted and cannot be restored.
- Pricing and Fee Changes
8.1 The GHL extension is currently included at no additional cost to the Business Plan of Bodygraph.com subscription.
8.2 Bodygraph.com reserves the right to introduce or modify fees for access to the GHL extension with reasonable advance notice.
8.3 Continued use of the GHL extension after fee changes constitutes acceptance of the new pricing.
- Modification or Discontinuation
9.1 Bodygraph.com reserves the right, at any time to:
9.1.1 Modify, suspend, or permanently discontinue access to the GHL extension with reasonable advance notice.
9.1.2 Adjust or restrict functionality or eligibility criteria.
9.2 Bodygraph.com shall not be liable for any resulting loss or damages.
- Eligibility and Access
10.1 Access is available only to active Bodygraph.com Business Plan subscribers.
10.2 Access will be revoked upon cancellation, lapse due to unpaid invoices, or downgrade of your subscription.
10.4 Unauthorized sharing of access credentials is strictly prohibited.
- Disclaimer of Warranties
11.1 The GHL extension is provided “as is” and “as available.”
11.2 Bodygraph.com makes no warranties, express or implied, including but not limited to:
11.2.1 Merchantability or fitness for a particular purpose.
11.2.2 Uninterrupted or error-free performance.
11.2.3 Accuracy or reliability of results.
- Indemnification
12.1 You agree to indemnify and hold harmless Bodygraph.com, its affiliates, officers, employees, and agents from any claims, damages, or expenses (including legal fees) arising from:
12.1.1 Your use of the GHL extension through Bodygraph.com subscription.
12.1.2 Your breach of these Terms.
12.1.3 Any data you submit or process through the extension.
- Limitation of Liability
13.1 To the fullest extent permitted by law:
13.1.1 Bodygraph.com assumes no responsibility or liability of any kind arising from or related to the use, performance, or availability of the GHL extension.
13.1.2 All claims, disputes, or issues relating to the GHL extension, including its functionality, data handling, or service performance, must be directed exclusively to Go High Level (GHL) as the developer and operator of the extension.
13.1.3 Bodygraph.com shall not be liable for any direct, indirect, incidental, consequential, or punitive damages, including but not limited to loss of data, business interruption, or loss of revenue, even if advised of the possibility of such damages.
13.1.4 Under no circumstances shall Bodygraph.com be required to provide compensation, refunds, or damages arising from the use or inability to use the GHL extension.
- User Responsibilities
14.1 You agree to:
14.1.1 Use the GHL extension in compliance with all applicable laws and regulations.
14.1.2 Maintain the confidentiality of your account credentials.
14.1.3 Not misuse, interfere with, or attempt to reverse engineer the integration.
14.1.4 Take full responsibility for reading, understanding, and complying with all Bodygraph.com and Go High Level (GHL) terms, conditions, and policies applicable to your use of the extension.
- Intellectual Property
15.1 All intellectual property in the GHL extension belongs to GoHighLevel.
15.2 All intellectual property in Bodygraph.com’s platform and related services remains with Bodygraph.com.
15.3 No ownership rights are transferred, merged or combined under these Terms.
- Termination
16.1 Bodygraph.com may terminate or suspend your access to the GHL extension at any time, with reasonable notice, or immediately in the event of a breach of any Bodygraph.com terms.
16.2 Upon termination, your rights to use the extension immediately cease.
16.3 Any parts of these Terms that are meant to continue after termination will still apply.
- Changes to Terms
17.1 Bodygraph.com may update these Terms of Use at any time without prior notice.
17.2 Updates take effect immediately upon posting or notification.
17.3 Continued use of the GHL extension constitutes acceptance of the updated Terms.
- Severability
18.1 If any provision of these Terms is held invalid, the remaining provisions will remain in full force and effect.
- Entire Agreement
19.1 These Terms, together with Bodygraph.com’s Terms of Service and Privacy Policy, form the entire agreement regarding use of the GHL extension.
- Governing Law and Jurisdiction
20.1 These Terms are governed by and construed in accordance with the laws of England and Wales.
20.2 Any disputes shall be resolved exclusively in the courts of England and Wales.
